Mark Lister LL.B (Hons)

Director and Solicitor

Mark is a qualified solicitor with over 20 years of experience in the legal profession. Mark carried out his training at a leading Birmingham law firm before being appointed Head of the Private Client department at a prominent Staffordshire legal practice where he became a Partner. Following the successful building of a Private Client department in Staffordshire, Mark relocated to Devon and has worked in two long established law firms in the local area.

Mark’s field of expertise focuses on the private client area of law but is supported by his ability to recognise other tax and estate planning solutions for clients. He has a diverse knowledge of advanced tax planning solutions for both individuals and corporate entities.

Mark has vast experience of tax planning structures in the UK and internationally to meet client objectives. He works closely with other professional intermediaries such as accountants, financial advisers and fund managers to identify and implement tax and estate planning strategies designed to meet the specific needs of clients.

Mark works alongside his fellow director and co-founder of the practice, Charlotte Langley, and is supported by his legal assistant and practise manager, Abigail Salter .

Another unique area of Mark’s expertise includes specialist work relating to the protection of the environment from pollution and was instrumental in agreeing a structure with the Environment Agency for the making and maintaining of financial provision for the aftercare requirements of landfill sites.

Due to his taxation and trust experience, Mark then developed what became known as ‘FillSecure’ – a trust used to hold funds required for the capping and/or aftercare costs for a landfill site. It took over two years of negotiation and development work to design this ‘solution’, with the first case being approved by the Environment Agency in 2008.

Since the approval of the trust based solution for landfill operators, Mark has spent a considerable amount of time identifying other applications for the Bespoke Trust Solution in such areas as energy, waste management and environmental risks. It had occurred to him that the basic bespoke trust concept could be developed for use in many other industries and scenarios – if a company is required to set aside significant funds to pay for a future liability and there are regulatory, or corporate reasons for ensuring that these funds are legally protected only for use on the specific site/facility, then using his experience a solution could be designed to meet this requirement.

Mark has three daughters and a Yorkshire Terrier named Mia. In his spare time, Mark is an avid follower of most sports and was proud to represent Great Britain in the 1996 Atlanta Paralympic Games. A strong interest in the stock markets combined with his desire to explore the world on cruise ships fills the rest of his time.
